Privacy Policy
BricksBam (“BricksBam”, “we”, “us”, “our”) respects your privacy. This Privacy Policy explains how we collect, use, share and protect your personal data when you visit bricksbam.com (the “Website”), contact us by phone, WhatsApp or email, or use our property advisory services. It is published in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”), the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
By using the Website or sharing your details with us, you agree to this Privacy Policy. If you do not agree, please do not use the Website or share your personal data with us.
1. Who we are
BricksBam is a real estate advisory and brokerage firm based at Spectrum Metro Mall, opposite Sector 50 Metro Station, Noida, Uttar Pradesh, India. We help buyers and investors purchase ready-to-move flats, office spaces and new-launch projects. For the purposes of the DPDP Act, BricksBam is the Data Fiduciary for the personal data described in this policy.
2. Personal data we collect
2.1 Data you give us
- Contact details: name, mobile number, email address.
- Requirement details: property type (flat / office), preferred location, budget, and any message you write to us.
- Transaction details (only if you proceed with a purchase): details needed for site visits, booking, home-loan assistance and registration, such as address, PAN, Aadhaar or other KYC documents that the developer, bank or registrar requires. We collect these only when you ask us to help with a transaction, and only to the extent needed.
2.2 Data collected automatically
- Technical data: IP address, browser and device type, pages viewed and time spent, collected in standard server logs by our hosting provider.
- Cookies and similar technologies: see Section 6.
2.3 Data we do not collect on the Website
We do not collect payment card, bank account or password information through the Website. We never ask for OTPs. BricksBam will never ask you to transfer booking money to a personal account; payments for a property are always made directly to the developer’s RERA-designated project account or the seller, as applicable.
3. How we use your personal data
- To respond to your enquiry and understand your property requirement.
- To share suitable property options, price lists, brochures and availability.
- To arrange and accompany site visits.
- To help with negotiation, booking, home-loan applications, documentation and registration, at your request.
- To send you updates about new launches and offers that match your interest (you can opt out at any time; see Section 11).
- To keep records required by law, including under the Real Estate (Regulation and Development) Act, 2016 and tax laws.
- To keep the Website secure, prevent fraud, and improve our services.
We do not sell your personal data.
4. Consent and legal basis
We process your personal data on the basis of your consent, which you give when you submit an enquiry, message us on WhatsApp, call us, or share documents with us. We may also process data for legitimate uses allowed under Section 7 of the DPDP Act, such as complying with a legal obligation or a court order.
You may withdraw your consent at any time by writing to us (Section 14). Withdrawal does not affect processing already done, and we may be unable to continue assisting you with a transaction that depends on that data.
5. Who we share your data with
We share only what is necessary, and only for the purposes above:
- Developers / builders and property sellers of the projects you are interested in, to register you as our client, arrange site visits and process bookings.
- Banks and housing finance companies, if you ask us to help with a home loan.
- Legal, registration and documentation professionals involved in your transaction.
- Service providers that help us run our business (for example website hosting, email and WhatsApp), who process data on our instructions.
- Government or regulatory authorities (including RERA, tax authorities and law-enforcement agencies) where required by law.
Each of these parties has its own privacy obligations. We ask our service providers to protect your data and use it only for the purpose we share it for.
6. Cookies and third-party services
The Website itself does not run advertising or tracking cookies. It uses the following third-party services, which may set cookies or collect technical data under their own privacy policies:
- Google Maps (embedded office map): Google Privacy Policy.
- Google Fonts (website typography): Google Privacy Policy.
- WhatsApp (when you click “Enquire” or submit the form, WhatsApp opens with your message): WhatsApp Privacy Policy.
If we add analytics or advertising tools in future, we will update this policy and, where required, ask for your consent. You can block or delete cookies in your browser settings.
7. How long we keep your data
- Enquiries that do not lead to a transaction: up to 24 months from our last contact with you, after which we delete or anonymise them.
- Completed transactions: for as long as required under applicable laws (including tax and RERA record-keeping), generally up to 8 years.
- If you withdraw consent or ask us to erase your data, we will delete it unless we are legally required to keep it.
8. How we protect your data
We use reasonable security practices, including HTTPS encryption on the Website, restricted access to client records, and secure storage of documents. However, no method of transmission or storage is completely secure. If a personal data breach occurs, we will notify affected users and the Data Protection Board of India as required by the DPDP Act.
9. Your rights
Under the DPDP Act you have the right to:
- Access: ask what personal data we hold about you and how it is used.
- Correction and completion: ask us to correct inaccurate or incomplete data.
- Erasure: ask us to delete your data when it is no longer needed.
- Withdraw consent at any time.
- Nominate another person to exercise your rights in case of death or incapacity.
- Grievance redressal: raise a complaint with our Grievance Officer (Section 14), and if unresolved, with the Data Protection Board of India.
To exercise any right, email us from your registered email or message us from your registered mobile number. We will respond within 30 days.
10. Children
Our services are meant for adults. We do not knowingly collect personal data of anyone under 18 years of age. If you believe a child has shared data with us, please contact us and we will delete it.
11. Calls, WhatsApp and DND
When you submit an enquiry, you authorise BricksBam to contact you by phone call, SMS, WhatsApp or email about your requirement, even if your number is registered on the National Do Not Call (DND) registry. You can stop marketing messages at any time by replying “STOP” on WhatsApp or writing to us; we will still contact you about an active transaction if needed.
12. Where your data is stored
Your data is primarily stored in India. Some service providers (such as email or messaging platforms) may process data on servers outside India. Any such transfer is made only to countries not restricted by the Government of India under the DPDP Act.
