1. Acceptance of these terms

These Terms & Conditions (“Terms”) govern your use of bricksbam.com (the “Website”) and the property advisory and brokerage services offered by BricksBam (“BricksBam”, “we”, “us”). By accessing the Website or contacting us through it, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

This Website is an electronic record under the Information Technology Act, 2000 and the rules made under it, and does not require any physical or digital signature.

2. About BricksBam

BricksBam is a real estate advisory firm and channel partner / real estate agent based at Spectrum Metro Mall, opposite Sector 50 Metro Station, Noida, Uttar Pradesh. We are not the developer, builder or promoter of any project listed on this Website unless expressly stated. We help buyers and investors discover, compare, visit, negotiate and purchase properties developed or owned by third parties.

3. Property information is indicative

• All information on the Website, including project names, prices, price per sq.ft, sizes, configurations, possession dates, amenities, specifications and availability, is indicative. It is compiled from developers, RERA filings and market sources, and was accurate to the best of our knowledge on the date stated.
• Prices and availability change frequently and are subject to the developer’s or seller’s current price list, taxes (GST, stamp duty, registration), PLC, parking, club and maintenance charges, which are generally extra.
• Nothing on the Website is an offer, invitation to offer, or contract. A binding agreement arises only from the allotment letter / agreement for sale signed between you and the developer or seller.
• Buyers must independently verify all details, including title, approvals, RERA registration, carpet area and payment plan, before making any payment.

4. RERA

RERA registration numbers shown on the Website are as published on the relevant RERA portal. Buyers should verify project details on up-rera.in (Uttar Pradesh) or maharera.maharashtra.gov.in (Maharashtra) before booking. Areas are stated as per the developer’s disclosures; under RERA, sale is on carpet area.

5. Images, renders and content

• Project images may be artist’s impressions, 3D renders or representative photographs and may not show the actual finished project, unit, view or amenities. Furniture, fittings and landscaping shown are for illustration only.
• Project names, logos and images belong to their respective developers and owners and are used only to identify and represent those projects. If you are a rights holder and object to any image, write to us and we will remove it promptly.

6. No investment or financial advice; no guaranteed returns

Content such as “Invest Now”, “Upcoming Projects”, pre-launch pricing, rental yields or appreciation potential is general market information, not investment, legal, tax or financial advice. Real estate values can rise or fall. BricksBam does not guarantee any return, rental income, appreciation, resale value or possession date. Please take independent professional advice before investing.

7. Brokerage and payments

• Our brokerage / service fee, if any, is agreed with you in writing before we act on a transaction. In many new-launch and developer projects our fee is paid by the developer, and there is no charge to the buyer; we will tell you in advance if a fee is payable by you.
• All payments towards a property must be made only to the developer’s RERA-designated bank account or the seller, by cheque, demand draft or bank transfer. Never pay booking or sale money to any individual’s personal account. BricksBam will never ask you for OTPs, passwords or card details.
• Expression of interest (EOI) or booking amounts are governed by the developer’s own terms and refund policy.

8. Your obligations

You agree to provide true and accurate information, to use the Website only for lawful purposes, and not to:

• copy, scrape or republish Website content or listings for commercial use without permission;
• attempt to hack, overload or disrupt the Website;
• submit false enquiries or impersonate another person.

9. Consent to be contacted

By submitting an enquiry, clicking “Enquire”, or messaging us, you authorise BricksBam and its representatives to contact you by call, SMS, WhatsApp or email about your requirement and related properties, notwithstanding registration of your number on the National Do Not Call (DND) registry. You may opt out at any time as described in our Privacy Policy.

10. Intellectual property

The BricksBam name, logo, Website design, text and compilation of listings are owned by or licensed to BricksBam. Third-party trademarks and images remain the property of their owners. No licence is granted to you except to view the Website for personal, non-commercial use.

11. Third-party links and services

The Website links to third-party websites and services (such as developer sites, RERA portals, Google Maps and WhatsApp). We do not control and are not responsible for their content, availability or privacy practices.

12. Limitation of liability

To the maximum extent permitted by law, BricksBam, its partners and employees shall not be liable for any indirect, incidental or consequential loss, including loss of profit, arising from use of the Website or reliance on its content. BricksBam is not responsible for any act, delay, default, change in plans, construction quality or possession delay by a developer, seller, bank or any other third party. Where liability cannot be excluded, our total liability shall not exceed the brokerage fee (if any) actually received by us from you for the transaction in question.

13. Indemnity

You agree to indemnify BricksBam against any claims, losses or costs arising from your breach of these Terms, misuse of the Website, or false information provided by you.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to any remedy available to you before RERA or a consumer forum, the courts at Gautam Buddh Nagar (Noida), Uttar Pradesh shall have exclusive jurisdiction. We encourage you to first contact us so we can try to resolve any concern amicably.

15. General

• We may update these Terms at any time; the updated version applies from the date it is posted on this page.
• If any provision is held invalid, the remaining provisions remain in force.
• Our failure to enforce any provision is not a waiver of it.
